Please review these Terms and Conditions (the “Terms”), as they constitute an agreement between you and mybarndominiumplans.com (“My Barndominium Plans,” the “Company,” “us,” or “we”) and govern your use of our Website and the purchase and/or licensing of any Company or Website-related products and services. By visiting our Website and/or purchasing or licensing any Company or Website-related products and services, including, without limitation, house plans (the “Plans”), you agree to be legally bound by these Terms. It is your responsibility to read these Terms before using this Website. If you do not agree to the Terms, you are prohibited from accessing or using the Website and/or purchasing or licensing any Company or Website-related products and services. The Company retains the right to modify these Terms from time to time as necessary without prior notice. Therefore, you should review them each time you visit the Website and/or purchase or license any Company or Website-related products and services. Your continued use of this Website after changes to these Terms will constitute your acceptance of such changes.

Overview
When you order Plans from the Company, you agree to the following, in accordance with these Terms: (i) if the Company owns any intellectual property rights in the Plans, the Company licenses those intellectual property rights directly to you in accordance with these Terms; (ii) if the Company has licensed the rights to use the Plans from a third-party designer, the Company sublicenses the rights to you to use the Plans in accordance with these Terms.
For all plan purchases, you will be responsible for any and all applicable sales or similar taxes and shipping and handling costs, if specified. All orders placed through the Website are final, and no refunds will be provided for any reason. We are not responsible for pricing, typographical, or other errors in any offers and reserve the right to cancel orders arising from such errors. Unless otherwise stated, all monetary amounts referenced on the Website are in United States Dollars.
Before You Make a Purchase on the Website
You acknowledge and agree that it is important to consider several factors before licensing or purchasing any Company or Website-related products or services, including, without limitation, Plans. In accordance with these Terms, you represent that you have familiarized yourself with the process of licensing or purchasing the types of products and services available on the Website, including consulting your local building department, builder, architect, engineer, or other construction professional associated with the Plans. You also acknowledge that the Plans are not specifically designed to comply with the laws, statutes, regulations, rules, ordinances, or building codes of any specific jurisdiction. Modifications to the Plans and/or additional compliance requirements may be necessary to meet local codes and regulations where and when you plan to build.
Making Purchases on the Website
If you wish to purchase or license Company or Website-related products or services, including Plans, you may be asked to provide certain information, including personal contact details and payment information. You understand that any such information will be treated by the Company as described in its Privacy Policy.
You warrant and represent that all information you provide in connection with any purchase or license on the Website will be accurate, complete, and current. You also agree to pay all charges incurred by users of your account and payment mechanisms at the prices in effect at the time such charges are incurred. You will be responsible for paying any applicable taxes related to your purchases.
Returns and Refunds

License
Upon purchasing Plans from the Company through the Website, you are granted, subject to these Terms, a limited, non-exclusive license (“License”) to use the Plans to build the barndominium or structure depicted in the Plans (the “Project”). Unless otherwise explicitly stated in your purchase confirmation, the License grants you the right to use the Plans to build the barndominium or structure once and only once. You may modify and reproduce the Plans solely to satisfy your specific needs and/or meet the requirements of Applicable Laws in completing the construction of your barndominium or structure. The License shall terminate upon the completion or abandonment of the Project.
Additionally, you agree to comply with the following restrictions and conditions of the License: (i) you are prohibited from assigning, sublicensing, or transferring the License without the express written consent of the Company; (ii) you may not create derivative works from the Plans, except for modifications necessary for your own use in constructing a single barndominium or structure; (iii) you may not reuse the Plans for additional projects without prior written consent and payment of a reuse fee; (iv) you may only share the Plans with contractors, consultants, lenders, or government agencies as reasonably required for building a single structure; (v) you agree to have the Plans reviewed by a local professional designer or engineer before beginning construction; and (vi) you will maintain adequate liability and other insurance coverage throughout the construction of your barndominium or structure.
Responsibilities Assumed by You and Your Builder
By purchasing Plans, you acknowledge that the following items are your or your builder’s responsibility, not the Website or the Company’s:
- Ensuring that all work complies with the latest edition of construction standards and Applicable Laws
- Obtaining all legally required permits and inspections
- Verifying all dimensions, details, lot conditions, and measurements prior to construction
- Adapting the Plans to local conditions, codes, and materials
- Selecting materials and ensuring construction practices that result in a structurally sound, weatherproof structure
- Managing construction sequencing, safety, and quality control
- Ensuring all materials and equipment meet manufacturer standards and warranty requirements
Intellectual Property Rights
The Company or its licensors own all intellectual property rights in the Website, including the Plans, and all related visual, textual, and technological content. The Company’s Plans are protected by U.S. and international intellectual property laws. Unauthorized use, reproduction, or distribution of the Plans is prohibited and may result in legal action.
Indemnification
You agree to indemnify and defend the Company, its affiliates, and other licensors against any and all claims, damages, liabilities, and costs arising from your use or misuse of the Website or the Plans, or any breach of these Terms.
Disclaimer
ALL PLANS AND SERVICES PROVIDED ON THE WEBSITE ARE SOLD “AS IS” WITHOUT WARRANTIES OF ANY KIND. YOU ASSUME FULL RESPONSIBILITY FOR ENSURING THE PLANS MEET YOUR NEEDS AND COMPLY WITH APPLICABLE LAWS. THE COMPANY DISCLAIMS ANY LIABILITY FOR ERRORS, OMISSIONS, OR FAILURE TO COMPLY WITH LOCAL REQUIREMENTS.
Additional Caveats, Disclaimers, and Requirements
It is your responsibility to ensure that your barndominium or structure complies with local building codes and regulations. The Company is not responsible for any plan interpretation or construction issues. You must verify all lot conditions, measurements, and professional requirements before construction. Some areas may require plan reviews by licensed architects or engineers.
Limitations of Liability
The Company is not liable for any indirect, incidental, or consequential damages arising from your use of the Website or Plans. If liability is imposed, it will be limited to the amount you paid to the Company.
Termination
The Company may terminate your License or access to the Website if you fail to comply with these Terms.
Disputes, Governing Law, and Jurisdiction
These Terms are governed by the laws of Texas, and any disputes will be resolved in Texas courts. You waive your right to a jury trial in any legal action related to these Terms.
Force Majeure
The Company is not liable for delays or failures caused by circumstances beyond its control, including natural disasters, government actions, or labor disputes.
Miscellaneous
These Terms represent the entire agreement between you and the Company regarding the subject matter and supersede any prior agreements.
